HC questions legality of Jessore youth’s imprisonment
The High Court today questioned the legality of sentencing a youth to two years imprisonment by a mobile court in Chaugachha upazila of Jessore for having drug.
It issued a rule upon the government to explain as to why convicting to 23-year-old Mahabur Rahman Tito by the mobile court conducted by Chaugachha Upazila Nirbahi Officer Nargis Parvin should not be declared illegal.
Issuing a suo moto rule, the court also ordered superintendent of police in Jessore to submit a report after investigating the incident of Tito's punishment by November 27.
Following the order, Chaugachha UNO Nargis, also an executive magistrate, will have to submit a statement on her role connecting the incident by November 27.
The HC bench Justice Qazi Reza-Ul Haque and Justice Mohammad Ullah came up with the suo moto rule following a report on the youth's punishment published on Bangla daily Prothom Alo on November 7.
According to the Prothom Alo report, Tito was sentenced after police detained him and seized drug (gaza) from his possession in front of Chaugachha Police Station.
