Plea seeks dissolution of parliament

A Supreme Court lawyer today filed a writ petition with the High Court seeking its directive on the authorities concerned to dissolve the current parliament in 42 days before next parliamentary election.

Advocate Md Eunus Ali Akond submitted the petition also praying to the HC to order the authorities to hold the next parliamentary election under a caretaker government in a new shape.

Advocate Eunus said in the petition that the Supreme Court in its 13th amendment judgment said that two parliamentary election may be held under the caretaker system subject to the condition that the selection of the chief advisor should not be made from any retired chief justices or retired judges of the Appellate Division.

He also said that the apex court in its 16th amendment judgment said our parliamentary democracy is immature. Besides, 153 parliament members who were not elected by the people cannot remain in the parliament. Therefore, the parliament should be dissolved, he said the petition.

In the petition, Eunus Ali requested the HC to issue a rule asking the government and the election commission to explain why they should not be directed to dissolve the parliament 42 days before the next parliamentary election and to take necessary steps to form a caretaker government in a new shape for holding the election.

In the required rule, secretaries to the law ministry, cabinet secretary, president secretary, prime minister secretary , Jatiya Sangsad secretary and chief election commissioner have been made respondents.

Advocate Eunus told The Daily Star that the HC may hold hearing on the writ petition tomorrow.
