Accused sent to jail, lawyer gets time to reply
One person was to jail yesterday in a cheque bounce case for submitting a forged High Court (HC) order to a Dhaka court for staying the proceeding of the case for six months.
Judge Monir Kamal of the Fourth Assistant Sessions Judge's Court of Dhaka also cancelled the bail earlier granted by him in connection with the case.
Advocate Manik Chandra Das submitted an HC order sheet to the court on April 17 last year saying that the HC stayed the proceeding of the case on April 4 for six months.
After scrutinising the HC order sheet submitted by an advocate on behalf of the accused, Judge Monir Kamal stayed the trial proceeding till October 9 last year.
But the complainant of the case came to know that the order sheet submitted to the court by the accused was a forged one. The complainant also came to know that the HC order sheet which was filed to the trial court was filed with Domar Police Station in Nilphamari district on November 5, 2010.
But the cheque bounce case was filed with a Dhaka court on June 22, 2009.
Advocate Ruhul Amin on behalf of the complainant Tofazzal Hossain submitted a petition to the trial court on January 17 this year saying that the HC order sheet submitted by the accused was false and forged one. He also appealed for taking action against the accused.
The judge issued a show cause notice asking Advocate Manik Chandra Das and accused Abdul Awal Sarkar on March 8 this year to explain why a legal action would not be taken against them for their alleged involvement with submitting a forged HC order sheet.
Advocate Manik and Awal appealed to the court seeking time to submit a reply against the show cause notice. The court, however, gave time to the lawyer and sent the accused to jail cancelling his bail.
