Deposition of PWs not recorded for absence of main accused

Sylhet Divisional Speedy Trial Tribunal yesterday could not record the deposition of the prosecution witnesses(PWs) in two cases, as the principal accused Mufti Abdul Hannan could not be produced in court. Six excluding Hannan were brought to the court as the Huji chief was scheduled to appear in another court yesterday. The judge set 30 August for recording the deposition of prosecution witnesses, Special Public Prosecutor Kishore Kumar Kar said. The court, till 12 August, so far recorded deposition of the 24 PWs out of 63 in the two cases filed after the grenade attack on a rally of AL leader Suranjit Sengupta on 21 June, 2004 at Derai in Sunamganj. The incident left one AL activist killed and over 30 others injured. Later two cases were filed -- one under Explosive Substances Act and the other for killing. The same court on 30 June this year framed charges against the accused and started recording depositions on 13 July, court sources informed. The prosecution witnesses who gave their deposition yesterday included former first class magistrate Hazera Khatun, She had earlier recorded the confessional statements of the accused Mufti Mainuddin, the investigation officer (IO) and others. Tribunal judge Md. Mahbub Ul Islam later fixed fresh date for recording the deposition . AL activist Abdul Wahid, 45, was killed while at least 30 others sustained injuries as a grenade was thrown on dais immediately after the public meeting at Derai. However, AL stalwart Suranjit Sengupta MP and other leaders escaped unhurt as they got down from the dais moments before the attack. The investigation officer in the case was changed 6 times as they miserably failed to find any clue to the blast. Finally CID Inspector Shafiqur Rahman on 14 December, 2008 filed charge sheet in the two cases accusing Mufti Hannan and 6 others of the attack, court sources informed. The other accused are Mufti Hannan's younger brother Mofizul Islam alias Mohibullah, Shariful Alam Bipul, Delwar Hossain Ripon, Hafiz Nayeem Ahmed, Mufti Main Uddin and Naziur Rahman Nazu. Considering the importance of the case, through a gazette notification by the Ministry of Home Affairs it was to the Divisional Speedy Trial Tribunal. The case records reached the tribunal on 4 October last year.
