Tipu murder case: HC cancels bail of 5 accused over forged documents

The High Court yesterday cancelled its earlier order that granted bail to five accused in a murder case in Khulna as they were found to have manipulated documents and hidden information about the charge sheet and confessional statements to this court while securing bail.

The court ordered the five accused to immediately surrender to the trial court concerned in connection with the case filed over murder of Tipu Sheikh, Attorney General Mahbubey Alam told The Daily Star.

The High Court also ordered Advocate Abu Hena Mostafa Kamal, the lawyer of the accused persons, not to practice law before any virtual court and issued a notice asking the lawyer why action should not be taken against him for helping the five murder case accused secure bail through forgery.

The HC bench of Justice Jahangir Hossain Selim passed the order after the attorney general yesterday informed the court about the forgery.

Attorney General Mahbubey Alam told this newspaper that the five accused -- Lutfor Sheikh, Sohag Sheikh, Jewel Sheikh, Selim Sheikh and Abdullah Mollah -- secured ad-interim bail from the same High Court bench on May 17 in the case filed for killing of Tipu Sheikh at Digholia in Khulna.

The family members of Tipu Sheikh told the attorney general's office that the accused of the murder case have manipulated the relevant papers of the case, hidden information about the charge sheet and their confessional statements before the High Court bench during the hearing of their bail petition.

"This is a big forgery with the High Court during its virtual proceedings. I have placed the information of forgery to the High Court bench. The bench cancelled the bail of the five accused and ordered them to surrender to the trial court immediately," Advocate Mahbubey Alam said.

He also said Advocate Abu Hena Mostafa Kamal cannot practice law before any virtual court until disposal of the show-cause notice issued by the High Court.

Advocate Kamal could not be reached for comment on the issue.
