Take legal action against informant of ‘false’ case in Patuakhali: HC

The High Court today directed police to take legal action against an informant of a 'false' murder case filed in Patuakhali.

The HC ordered Patuakhali Police Station to file a criminal case against Md Jalil Duari, the informant of the case filed on charge of killing his daughter Sathi Akhter, under Section 211 of the Penal Code of Bangladesh.

The HC bench of Justice Jahangir Hossain Selim and Justice Md Badruzzaman came up with the order during hearing a petition filed by Md Kawsar Gazi, the main accused of the murder case, seeking bail.

Citing the case documents, Deputy Attorney General Dr Md Bashir Ullah told The Daily Star that Kawsar Gazi of Town Bohal Gachhia village in Patuakhali brutally killed his wife Sathi Akhter, 25, centring family dispute on December 31, 2018.

Her body was buried after post mortem.

Sathi Akhter's father Jalil Duari filed a murder case with Patuakhali Police Station on March 12, 2019.

Sathi's daughter Faria Afroj, a minor, gave a statement to the magistrate concerned saying that her father Kawsar Gazi and his (Kawsar) father hit her mother with sticks and they killed her.

Later on, Kawsar and his father hanged the body of Sathi Akhter with a rope, Faria told the magistrate.

DAG Bashir Ullah said the post mortem report mentioned injury mark on the head of Sathi Akhter.

However, Sathi Akhter's father Jalil Duari on July 27, 2019 filed an affidavit to the lower court concerned of Patuakhali, saying that his daughter died by suicide.

Jalil Duari said in the affidavit that he filed the murder case falsely against Kawsar Gazi at the instigation of a group and he has no objection if Kawsar Gazi is granted bail.

Kawsar Gazi's lawyer Md Asad Miah told this correspondent that the HC today granted bail to his client who has been in Patuakhali jail since March 14, 2019, following the statement of Jalil Duari in the affidavit.

The lawyer said he placed the affidavit of Jalil Duari along with the bail petition of Kawsar Gazi before HC bench.

The trial court will decide the authenticity of the case filed over the death of Sathi Akhter through examining the documents and evidence.

DAG Bashir Ullah said maximum punishment under Section 211 of the Penal of Bangladesh for filing a false case is seven years' imprisonment.
