HC questions legality of PSC’s recommendation of appointing 5,054 nurses

Asks why PSC should not be directed to appoint the 51 writ petitioners who had previously passed tests to the posts

The High Court today questioned the legality of the Public Service Commission's (PSC) recommendation of appointing 5,054 senior staff nurses.

In response to a writ petition, the court issued a rule asking the authorities concerned of the government and the PSC to explain in four weeks why the recommendation should not be declared illegal.

In the rule, the HC also asked the authorities to show causes of why they should not be directed to appoint 51 writ petitioners, who had qualified for the relevant tests to the posts of senior staff nurse.

The bench of Justice Obaidul Hassan and Justice AKM Zahirul Huq came up with the rule following a writ petition filed collectively by 51 candidates who were deprived of PSC's recommendation of appointment.

Writ petitioners' counsel Aneek R Haque told The Daily Star that his clients have passed the written and viva voce exams held in 2018 for the posts of senior staff nurses, but they were not recommended due to accommodation crisis.

But, the PSC recommended in April this year for the appointment of 5,054 candidates, including 15 to 20 ones who had not passed the relevant tests and exams which is illegal, he said, adding that considering this ground, the HC issued the rule.
