SC asks petitioner to file leave-to-appeal

The Supreme Court yesterday asked a writ petitioner to file a regular leave-to-appeal petition seeking permission for moving a regular appeal with this court against a High Court verdict on the wheat imported from Brazil after receiving its full text.

Following the writ petition filed by Pabel Mia, a Dhaka court lawyer, the HC on July 8 had directed the government to take back the wheat from a department or organisation if they want to return the grain, considering it to be unfit for consumption.

The HC had also asked the government not to compel anyone to receive the imported wheat if they are unwilling to do so.

Yesterday, chamber judge of the SC's Appellate Division Justice Syed Mahmud Hossain passed the order during hearing a provisional leave-to-appeal petition filed by Pabel on July 14 against the HC judgement.

The apex court judge passed "no order" on the July 14 petition seeking SC directives upon the government to examine the wheat imported from Brazil at a "neutral laboratory" by collecting its sample through a committee formed by the SC.

In the petition, Pabel also prayed to the Appellate Division to order the Anti-Corruption Commission to conduct an inquiry into whether there was any corruption in importing the wheat and its release and distribution in the country.

Pabel's lawyer Shanjid Siddique told The Daily Star that the SC passed the no order, since it following a government petition on July 9 stayed the HC judgement till July 26.
