Kader Siddique's challenge against cancellation of candidacy scrapped by SC

Krishak Sramik Janata League President Abdul Kader Siddique filed a petition with the Supreme Court yesterday, challenging a High Court verdict that had upheld cancellation of his candidacy for Tangail-4 by-polls.

In the petition, Kader prayed to the apex court to stay the HC judgment and the process for holding election to Tangail-4 constituency.

After a hearing on the petition, chamber judge of the Appellate Division Justice Hasan Foez Siddique adjourned the hearing for two weeks and asked Kader to file a leave to appeal petition with the SC against the HC verdict within this period.

The Election Commission should not proceed for holding by-election to Tangail-4 in the next two weeks, as the matter is now pending before apex court SC, Kader's lawyer Raghib Rauf Chowdhury told reporters.

Meanwhile, the EC's lawyer Mohammad Yeasin Khan said his client had no legal bar to go ahead for holding the by-polls, as the SC chamber judge did not stay the HC judgement.

The HC on February 4 upheld the decision of the EC, which cancelled Kader's nomination over loan default allegation, and asked the commission to proceed to the process for holding the polls.

On September 16 last year, the EC issued a notification, fixing November 10 for the by-polls that fell vacant following the resignation of Awami League lawmaker Abdul Latif Siddique from parliament.

Following a government petition, the SC on November 2 last year stayed the process for holding the election till February 4 this year.
