Court warns SI for arresting innocent man in drug case

A tribunal in Dhaka today warned a Sub-Inspector of Brahmanpara Police Station of Cumilla for arresting Md Rajan Bhuiyan, an innocent man instead of the real accused, in connection with a drug case.

Judge Abu Zafar Md Kamruzzaman of the Speedy Trial Tribunal-1 of Dhaka passed the order after SI Mamenur Rashid of the police station before the tribunal and sought unconditional apology for his mistakes.

Meantime, the same tribunal rejected the bail petition and sent the real accused Md Habullah Rajan to jail after he surrendered before it seeking bail in the case.

Earlier on November 11, the tribunal granted bail to Rajan Bhuiyan and discharged him of charges, and directed the concerned police station not harass his family members.

The tribunal also directed Arshad to appear before it today and explain why legal action would not be taken against him for arresting an innocent man instead of the real accused in a drug case. 

On October 16 morning, SI Mamenur detained Rajan Bhuiyan, a mason by profession, from his house when he was sleeping.

The same day, a senior judicial magistrate’s court of Cumilla sent Rajan Bhuiyan to jail, after he was produced before it.

A supplementary order sheet was sent to the Dhaka tribunal on October 20 in the case.

On October 30, Rajan’s lawyer submitted a bail petition narrating the fact, saying Rajan Bhuiyan was not the real accused in the case. Police wrongfully arrested him instead of Habibullah Rajan.

The tribunal then directed Cumilla jail authorities to produce Rajan Bhuiyan before it on November 11. He was present at the court on that day.

Habibullah Rajan was accused in a case filed with Bangshal Police Station in the capital after 28 syringes containing drugs were recovered from him at Chairman Bari, Nayabazar in old Dhaka on May 9, 2012.

He was 26 years old when the arrest warrant was issued for him on June 6, 2013. He was arrested and sent to jail in the case but came out on bail after a few weeks.

Habibullah has since been on the run.
