Khandker Mahbub urges rehearing

Prominent lawyer and BNP leader Khandker Mahbub Hossain yesterday urged Chief Justice (CJ) Surendra Kumar Sinha to arrange a rehearing of the case in which the Supreme Court (SC) declared illegal the caretaker government system.

"As a lawyer I think the judgment…is illegal as it was written and signed by former Chief Justice ABM Khairul Haque 16 months after his retirement," he told journalists at his Supreme Court Bar Association (SCBA) chamber.

The CJ on January 19, in a statement marking his first year in office, said making unusual delays in writing judgements or orders and doing it after retirement was unlawful and unconstitutional.

He recently decided to rehear 168 cases involving two retired judges. The rehearings will start on May 5 by two SC benches.
