HC bench sits at night, confirms grandchildren of late attorney general KS Nabi can stay at ancestral house in Dhanmondi
In a rare move, two High Court judges have operated a bench last night and directed Dhanmondi Police Station to immediately take necessary steps so that two minor grandchildren of former attorney general KS Nabi can enter and live in his (KS Nabi) Dhanmondi residence.
The virtual HC bench of Justice Abu Taher Md Saifur Rahman and Justice Md Zakir Hossain also directed the officer in charge of Dhanmondi Police Station to ensure proper security of the minors – Kazi Adian Nabi and Kazi Nahian Nabi-- at the residence.
The bench came up with the directive on a suomuto (voluntary) move following a live discussion on the issue on a private television channel at last night.
Adian and Nahian, the grandchildren of the late attorney general, had not been allowed to enter their ancestral house at Dhanmondi by their paternal uncle.
After the HC passed the order, Dhanmondi Police Station has taken necessary steps to ensure that Adian and Nahian can live in their ancestral house in line with the HC order, and has also submitted a compliance report to the HC today, said Supreme Court lawyer Manzill Murshid, who participated in the live discussion.
Manzill Murshid told The Daily Star todaythat the HC judges have issued the suomuto order in order to establish human and fundamental rights of Adian and Nahian.
He said Adian and Nahin are the children of KS Nabi's son Kazi Siratun Nabi. They had been living in the ancestral four-storey building owned by KS Nabi at Dhanmondi area with their father Siratun Nabi.
Adian and Nahian went to their mother after their father Siratun Nabi passed away on August 10 this year. Siratun Nabi and his wife were in separation.
Recently, Adian and Nahian came back to their ancestral house with their aunt Meherin Ahmed. But their uncle (Siratun Nabi's elder brother) Kazi Rehan Nabi refused to allow them to enter the house.
Rehan did not open the gate of the house and therefore Adian and Nahian could not enter the residence, which was informed to the Dhanmondi Police Station, Manzill Murshid said, adding that the police did not take the allegation into cognisance.
Today, the HC bench accepted the police's compliance report and ordered Kazi Rehan Nabi and two minor boys Adian and Nahian to appear before it on October 11 to place their explanations.
The OC of Dhanmondi Police Station has been ordered to bring Adian and Nahian before the HC bench on October 11.
The HC also asked the OC to provide proper protection to Adian and Nahian at the residence till October 11 and fixed October 11 for passing necessary order on this issue.
