SC stays HC order on Nurul murder case
The order came on a petition submitted by the government against the High Court order
Chamber Judge of the Appellate Division Justice Mohammed Fazlul Karim heard the petition and stayed the operation of the High Court's stay order.
Following the order of the chamber judge, the trial of the case will continue.
The case is now pending with the Divisional Speedy Trail Tribunal, Chittagong.
Attorney General AF Hassan Ariff submitted that the High Court stayed the trial ignoring the set principles of law. It had not even issued rule upon the government for reply, which is prerequisite for granting stay, he added
On September 22, The High Court stayed the proceedings of the trial court in the case on hearing of a writ petition filed by accused Md Abu Taher, his wife Nazma Taher and three others with the High Court Division.
Deputy Asttorney General Helal Uddin Mollah and Assistant Attorney General Zaman Akter Bulbul assisted the Attorney General, while Advocate Ozaer Farooq appeared for the accused.
